IRS Notice CP 91/298- Final Notice Before Levy of Social Security Benefits

IRS uses Notice CP 91 or CP 298 to inform you they plan to take 15% of your social security benefits due to an outstanding balance on your account.

What Should I do First?

The first thing that you need to do is verify if you have an outstanding balance with the IRS.  You have 30 days from the date of the CP 91/298 notice to either pay or contact the IRS. The CP Notice 91/298 is a wakeup call and if you are not prepared to address this on your own, you should seek representation.

When Should I Respond to the IRS Regarding CP 91 / CP 298?

To avoid collection issues you MUST respond to this notice within the 30 days from the date of the notice. If you agree and you pay the balance in full, there is nothing else you need to do. Make sure that you use the payment voucher and envelope enclosed with the notice. This will insure that the payment gets credited to proper account.

What If I Realize I Cannot Pay Back Taxes?

If you cannot pay your account balance in full you should contact the IRS at the phone number listed on the notice.  You will have the normal resolution options such as an offer in compromise, installment agreement or other settlement options.  

Note: Failure to full pay the balance due or contacting the IRS will result in a levy against your Social Security benefits. Remember you do have appeal rights and should use them if needed.
